Grant Award Notice
The grant award notice approves funding and sets the conditions. The ancillary provisions matter more than the approved amount.
What is a grant award notice?
The grant award notice (German: Förderbescheid, often called a Zuwendungsbescheid) is the binding decision of an authority or promotional bank on an application. It states the approved amount, the funding purpose, the approval period and the conditions.
It is an administrative act (Verwaltungsakt). This means that a legal remedy is available against it, and that under certain conditions it can be revoked and the funding reclaimed.
The part most people skip
It is not the amount on page one that decides, but the ancillary provisions behind it. They set out what applies, and breaching them costs the funding.
Typical ancillary provisions:
- Earmarking: The funds may only be used for the approved purpose.
- Approval period: Expenditure outside the period is not eligible for funding.
- Notification duties: Changes to the project, to the shareholder structure or to other funding must be reported without delay.
- Procurement rules: Above certain amounts, comparative quotes must be obtained.
- Documentation duties: Interim and final proof of use, with deadlines.
- Retention duties for receipts and records.
The notification duty for investments
One point that is regularly overlooked in funding rounds: many notices require a material change in the shareholder structure to be reported.
The background is SME status and state aid law. If a large investor comes in, eligibility for funding may lapse, and a failure to notify turns a solvable problem into a repayment claim.
The proof of use
After the project is completed, it must be shown that the funds were used for the intended purpose: a numerical statement of the expenditure plus a factual report on the result.
What cannot be substantiated here is cut. That is why record-keeping should be set up from day one in the structure of the notice, not sorted at the end.
Common mistakes
- Reading only the amount. The conditions are at the back and apply nonetheless.
- Starting before approval. Many programmes fund only projects that have not yet begun. Starting early costs the funding.
- Not reporting changes. Even well-meant improvements to the project may require approval.
- Overlooking procurement rules. Without comparative quotes, the item is struck out.
- Misjudging deadlines. The proof of use has a date, and an extension must be applied for beforehand.
Frequently asked questions
Can the funding be reclaimed?
Yes, in the event of a breach of the ancillary provisions, use contrary to the purpose or false information. Interest is then regularly added.
What should be done if the project changes?
Report it beforehand and, where necessary, apply for an amendment of the notice. Retrospective approvals are much harder to obtain.
Can the amount be challenged?
Yes, with the legal remedy named in the notice within the deadline. In practice, a factual conversation with the approving body often gets further than a formal objection.
The Roemer Capital view
For clients with ongoing funding, we read through the ancillary provisions before a funding round starts. The reason is concrete: several notices contain a notification duty on a change of shareholders. Anyone who overlooks it has not only a new investor after closing but also a funding problem. This then surfaces in the next review.
